Looking Forward to 2012
To call Attorney General Holder’s plan to try the five perpetrators of the September 11 World Trade Center Attack and Murders in New York City, under the same judicial rules we would offer a common criminal, is a slap in the face of those who died in the attack, their loved ones and their friends, the citizens of New York City and finally, the citizens of this great nation.
To begin with, such a decision violates the Constitution. The Fifth Amendment plainly excepts such prisoners as belonging to that class of prisoner who is to be held to answer for a capital crime “arising in the land or naval forces” during time of war. If indeed these prisoners who are, in reality, no different than those whom the allies tried at Nuremburg and under other war crime tribunals, are not to be charged with war crimes, then why have over 4,000 of our servicemen died in Iraq and Afghanistan, as a direct result of the original 9-11 attack? Would we have gone to those two nations, to wage “war,” were it not for 9-11? Of course not.
Yes, President Bush used information from the CIA to his advantage in a period surrounding the 9-11 attacks, but his errors of omission relating to the so called weapons of mass destruction, in attacking radical Islam in those two nations, would never have passed the smell test were it not for the actions of these five terrorists. Take away 9-11, and our 4,000+ troops would still be alive. Yes, Saddam would still be ruling Iraq, but is he any more evil than Kim Jung Il or the Mullahs of Iran? To expect only the “good” to rule is a foolish pie in the sky wish of those who have been brainwashed, during their childhood and their education, by the far Left. Without 9-11, all those billions of dollars spent on the cost of war would have been spent in our own economy, and I shall give you a moment to consider the benefits of such a savings.
These terrorists should be tried in a military court, under the laws of a military tribunal, with all the restrictions that such a tribunal places upon prisoners of war and war criminals. Just how often do we turn the other cheek? Just how often do we give our enemy that which he does not deserve? Ask yourself, just how much compassion did those terrorists show the 3.000 who died in the Twin Towers?
Now that Obama and Holder have screwed up the entire picture by making this serious error of judgment, these five are now protected by the Sixth Amendment, which allows them an “impartial” jury (does that sound like a long drawn out motion for a change of venue?), and to have “compulsory process for obtaining witnesses in his favor” (does this sound like a soap box for anti-American propaganda?). It also allows them the “right” to demand of the prosecution, all records of their capture and interrogation processes, along with information pertaining to other investigative processes of the CIA and FBI, used during the entire investigation.
Can you begin to imagine how some of this evidence will come back to harm our investigative bodies, as far as our war against radical Islam and other forms of terrorism? Can you imagine the propaganda coup that will, not may, result from this trial and its revelations? Given the widespread media of today, versus that which was available in 1946, can you imagine the harm such a trial will do to the U.S. as far as its relations with the rest of the world? All I can imagine is that this is going to be one of the greatest blunders in foreign relations that the U.S. has ever suffered.
In addition, since when was our Constitution written to provide “rights” to non-citizens? Would the British have been tried in a civilian court for crimes perpetrated during the Revolutionary War. Did we provide such Constitutional rights to the conspirators in the murder of Lincoln? These were war crimes, and should be tried as such. These terrorists are being given the same rights as those provided to a common drug pusher. Please tell me that 7.000+ U.S. citizens, both civilian and soldier alike, have not given their lives so that we can show the same compassion to these five terrorists that we show to a petty second story thief.
Secondly, why give other would be terrorists another New York target. Remember, these people love the idea of martyrdom and placing the accused within the city of New York only adds fuel to the fervent fire of radical Islam, to wreck havoc on the city and its citizens once again. At least in a neutral location of a military tribunal, there would not necessarily be a creation of new civilian targets. Why make the survivors and the city go through the agony of the attack again, as all the gruesome details are once again splashed across the newspapers and shown on television sets?
Finally, although we suffered through 9-11, have not other nations suffered as a result of the same radicalism. Has not Spain suffered Islamic radical bombings. Have not the British lost young men in the war as well as other nations losing men? Why must the trial be held in a U.S. civilian court? Is not the Hague a proper institution for a military tribunal for international war criminals? Is that not where the war criminals from the Yugoslavian region are being tried? Why not these war criminals from the Middle East?
In my opinion, this decision by the Obama administration is another example of just how far out of touch with America our new President has gone and how blind his administration is to the feelings of the average American. President Obama is bringing Change, but it is apparent to me that it is the wrong type of change. Each and every move he makes weakens us just a little bit more, both physically, economically and in the eyes of the rest of the world. 2012 cannot come soon enough.
